Terms and Conditions

These are the General Terms and Conditions (hereinafter referred to as T&C) of klaar prims glass & craft, established at de Merodedreef 46, B-2260 Westerlo (Belgium), and with C.B.E. number 0700.124.917.

1. To whom do these conditions apply?

These T&C apply to every offer made by us to you as a consumer. A consumer is any natural person who purchases our designs exclusively for non-professional purposes via our webshop available at the following URL: klaar-prims.myshopify.com.

In order to place an order, you must be at least 18 years old. If you are not 18 years old, we ask you to let your parents or legal guardians place the order. If we notice that an order has been placed by a minor, we can refuse this order.

When placing an order through our webshop, you explicitly agree with our T&C which are always available through the website.

If you order online, we will also send you a copy of these T&C in a format that you can save or print, together with the order confirmation or at the latest upon delivery.

2. Our offer and your order

If an offer has a limited validity or is subject to certain conditions, we will state this explicitly in our offer.

We always describe as completely and accurately as possible what we are selling you and how the ordering process will work. The description is in any case sufficiently detailed for you to make a proper assessment. If we use pictures, they are a true representation of the offered designs. Due to the mouth-blown production process, the colours and dimensions may vary slightly from the pictures in the webshop.

Your order is complete and the agreement between us is final as soon as we confirm your order by e-mail and as soon as we have received the approval of the card issuer for your payment transaction with credit or debit cards, or if you pay by bank transfer: as soon as the purchase amount is credited to our bank account. If the issuer of your card refuses to approve your payment to us, we are not responsible for delays in delivery or non-delivery of your order. We cannot accept or process orders without valid payment in the name of the registered cardholder.

To purchase a product, add the product to your shopping basket. Then enter your contact and billing information and confirm where we can deliver your order. Would you prefer to pick up your order? This is also possible by appointment. Select 'pick up' when you pay online and wait for the pick up confirmation e-mail before you come by so we can prepare your order.

In the final step, you will be presented with a summary page, accept our terms and conditions and confirm your payment by pressing the order button with the caption "order with payment obligation" or a similar wording. Once you have completed these steps, your purchase is final.

3. Right of withdrawal

When you purchase products from our webshop as a consumer within the EU, you have the right to decide, within 14 days after delivery, not to keep them. You can then return your order without paying a penalty and without giving a reason.

During the first 14 days after delivery we expect you to handle the order and its packaging with care. If you still wish to return the product as described above, you may only unpack or use it to the extent necessary to judge whether you wish to keep it. If you are returning your order, we expect you to use the original packaging and to return the products in their original condition.

Within 14 days of receiving your order back, we will refund you the full purchase price via bank transfer.

You can return your package by post or courier. You will therefore have to bear the direct costs of returning your order. The risk of the return shipment also lies with you. We are not responsible for returns that we do not receive. We recommend that you always keep your proof of sending.

To exercise your right of withdrawal quickly and correctly, please complete the form available via the following link and e-mail it to sales@klaarprims.be. We will send you an acknowledgement of receipt of your withdrawal by e-mail.

The right of withdrawal does not apply to custom-made products nor to purchases made by legal entities.

4. Price and payment

The prices are as indicated in our webshop.

When we make a particular offer, we will always indicate the duration. During the period we mention in our offer, our prices do not change, except for price changes due to changes in VAT rates.

Our prices include all taxes, VAT, duties and services. However, we may decide to charge shipping costs in addition to the purchase price. In that case, we will always inform you before you make your final purchase.

For Belgium we have free shipping, for orders outside Belgium but within the EU you pay 15EUR shipping costs.

We accept the following payment methods: Bancontact / iDEAL, VISA, MasterCard, American Express, Maestro.

5. Delivery

Upon receipt of your payment, we will prepare your order for shipment.

If the design you have chosen is in stock, we will deliver within 3 to 6 working days in the Benelux and within 3 to 10 working days to other countries in the EU.

If the design you ordered is no longer in stock, delivery will take place within 6 to 8 weeks. In that case, we will contact you by e-mail.

We will inform you about the delivery time in your order confirmation.

If we are unable to deliver on time, we will always inform you before the delivery period expires.

Our shipments are always at our risk. However, if the goods delivered by us were damaged during transport, do not correspond to the items listed on the delivery note or do not correspond to the items you ordered, you must report this as soon as possible and within 3 calendar days by e-mail (sales@klaarprims.be) and return the items to us within 14 calendar days after receipt.

We are not responsible for consequential damages due to late delivery or non-delivery by the carrier we have appointed.
Our liability is in all cases limited to the value of the goods you ordered.

6. Instructions for use and warranty

Our products are decorative objects that are not intended for use. Some products are utensils (such as glasses and carafes) that you may use taking into account the following instructions: our utensils are dishwasher safe. However, we recommend to clean the glasses and carafes by hand to prolong their life span.

If and insofar as we provide additional user instructions (which are, for example, supplied with the product), the guarantee lapses if these are not complied with.

We apply the statutory minimum guarantee period of two years to the delivery of products. This means that in the event of defects or faults in the goods up to 2 years after delivery, the goods will be repaired or replaced free of charge.

As far as possible and reasonable, you have the choice between repair or replacement. Only in the event that the repair or replacement is excessive or impossible, or cannot be carried out within a reasonable period of time, do you have the right to request a price reduction or the termination of the sales agreement.

The warranty is void if and insofar as you have not used the products in accordance with our instructions for use. The warranty is also void in case the products break due to carelessness or an accident.

7. Force majeure

In the event of force majeure, we shall not be obliged to fulfil our obligations. In that case, we may either suspend our obligations for the duration of the force majeure or definitively dissolve the agreement.

Force majeure is any circumstance beyond our control and will, which prevents us from fulfilling our obligations in whole or in part. We understand these circumstances to include strikes, fire, business interruptions, energy interruptions, disruptions in a (telecommunications) network or connection or used communication systems and/or the unavailability of our website at any time, non-delivery or late delivery by suppliers or other third parties, ...

8. Intellectual Property

Our website, logos, texts, photos, names and in general all our communications, as well as the designs of all our articles, are protected by intellectual property rights that belong either to us, our suppliers or other entitled parties.

It is not allowed to copy, edit, modify, etc. our intellectual property without our prior and express written consent.

9. Complaints and disputes

We hope that you are satisfied with your purchase. If you do have any complaints, please contact us at sales@klaarprims.be or by phone at +32476315151. We will send you an acknowledgement of receipt as soon as possible and do everything we can to deal with your complaint within 7 days.

In the event of out-of-court settlement of the dispute, the Consumers' Ombudsman Service of the Federal Government is authorised to receive any request for out-of-court settlement of consumer disputes. The latter will in turn either deal with the application itself or forward it to a qualified entity. We also inform you of the existence of the European Union's Online Dispute Resolution platform. If you wish to submit your request online, you can do so via http://ec.europa.eu/odr. This platform facilitates the online resolution of the dispute and puts you in contact with the competent qualified entity.

All agreements that we conclude with our customers, regardless of their place of residence, are governed exclusively by Belgian law and, in the event of a dispute, only the court of the place where our registered office is situated is competent.
